Guarantee terms and conditions
With this guarantee, NOVA Vertriebsges.m.b.H (below simply referred to as NOVA), assures the owner, as named in the warranty certificate (below simply referred to as the owner), 300 flying hours, up to a maximum of three years starting from the day of first purchase, that the paraglider bearing the serial number has no material or production flaws.
Should any material or production flaws occur during the period covered by the warranty, NOVA guarantees free of charge repairs, or to replace faulty parts, if all of the following terms are fulfilled. Should rectification of the fault not be possible or prove uneconomical, the owner will, if requested, receive a new glider of equal quality and type, on payment of the difference in value between the new equipment and the current value of the damaged equipment. The warranty does not apply to damage caused by incorrect use or normal wear and tear or faults that do not, or only slightly, affect the usability of the equipment. This guaranteed service may only be claimed by the owner named in the warranty certificate.
After registration by the owner or dealer, the owner receives a certificate with all data, dates and service schedule from the NOVA Quality Assurance Database.
All Nova paragliders purchased in Austria and Germany, will be checked with NOVA NTT (Nova Trim Tuning) by NOVA and its authorised service partners free of charge. The respective freight charges are not paid by Nova. The NTT is to be carried out in the country of purchase, within 12 months starting from date of purchase.
We recommend conducting the NTT after approximately 20 flying hours. If the first 20 flying hours have been completed within the first month, it is sensible to have the NTT then, rather than waiting until the 12 month period is over.
If the Nova glider is checked with NTT according to the outlined conditions and before the stated expiration date, the NFS (Nova Full Service) is to be carried out within 36 months, starting with the date of purchase. The NFS may only be conducted by Nova and its authorised service partners.
In case the glider is not checked with NTT within the first 12 months of first purchase, an NFS is to be carried out at the latest within the first 24 months starting from date of purchase.
In case the Nova glider has been registered in compliance with the Nova conditions, and an NTT and NFS have been carried out within the stated dates by Nova or an authorised service partner, the material warranty is extended to 48 months (if the glider has been flown less than 300 hours), starting with the date of purchase.
Conditions for guarantee and compensation obligations:
Guarantee and compensation obligations are only valid from the date given on the guarantee card issued by NOVA Quality Assurance Database.
Compensation claims for damage caused before this date will not honoured. The guarantee and compensation obligations only apply to private sport and leisure time activities, not, for example, for use for commercial purposes.
The owner must keep a flight logbook in which all flights undertaken on the purchased glider must be recorded and where at least the location, date and length of the flight are documented.
In the case of damage, the equipment together with the guarantee certificate and sales contract/receipt must be sent to NOVA or an authorised importer/dealer. Repairs or replacements of damaged parts will be undertaken exclusively by NOVA. If the work is undertaken by unauthorised third parties there is no entitlement to compensation. Further, the owner is not entitled to a replacement glider for the duration of the repair.
The current value of the paraglider is determined as follows: the loss in value is calculated at 3% per month from the date of purchase (date of sales contract/receipt). In the first year the list price will apply; in the following two years it will be calculated according to the existing current value on the 31st December of the previous year.
In the performance of guarantee and compensation obligations, the transportation for the glider and spare parts are at the cost and at the risk of the owner. Unusable gliders and parts (in the case of a write-off of the entire equipment) will become the property of NOVA.
The guarantee and compensation obligations on the part of NOVA are limited to those explicitly specified on the guarantee card. The repair or replacement of other faults or damage, in particular consequential damage resulting from defects, compensation for expenses, etc. are excluded. The statutory rights of the owner are, however, not affected. Legal guarantee deadlines are applicable in addition to this guarantee and these will not be extended.
Additional Conditions for Guarantee Obligations:
Guarantee obligations will only be performed if the fault is reported within the 4 year guarantee period and within 14 days of detection of the fault. Nova must be informed in writing by registered letter. Faults that are only reported after the guaranteed period has expired are not included in the guarantee if they were not recognised within the guaranteed period.
Additional Conditions for Compensation Obligations:
Within 14 days of the date of an accident, an accident report sent by registered mail together with the complete damaged equipment must be sent to NOVA or an authorised dealer/importer. The accident report must include the location and date of the incident as well as a description of the accident. If required by Nova, any further documents necessary to clarify the accident must be submitted to NOVA.
In cases of gross negligence or deliberate damage on the part of the owner, all claims for compensation will become null and void. This also applies to accidental damage caused by a third party.
For all compensation obligations fulfilled by NOVA, the owner is responsible for an excess of 63.50 euro incl VAT / + postage & packing. Compensation obligations will only be met after the complete payment of this amount.
If the above mentioned conditions are not completely met, NOVA is entitled to refuse to fulfil guarantee or compensation obligations.
